What is a Sponsor Licence?
Since the changes to UK immigration laws in recent years, if a business wants to bring in workers from outside the UK, they need to be approved sponsor licence holders.
The government introduced the UK sponsorship licence in 2021 to regulate visa applications after the UK left the EU. The sponsor licence scheme was implemented to ensure that only employees that were needed under the UK job shortage occupations list were bought to work in the UK.
This scheme was also implemented to better manage the immigration for work process, with sponsors needing to follow certain legal practices to bring talent to their businesses. The purpose of a sponsor licence ensures that:
- All employees from overseas are given the proper monitoring and legal support to alleviate pressure from government processes.
- Businesses are offering quality jobs, and fair salaries when bringing in talent to stop the exploitation of overseas workers.
Why Should You Receive Professional Help in Your Sponsor Licence Application?
When applying for your sponsor licence, many factors should be considered to ensure you are successful in your application. Not only will this save you money by ensuring you don’t have to pay to apply twice, but it also eliminates the delay you could experience when bringing staff to your business.
To receive a sponsor licence, holders must comply with the following:
- Holders must not have any unspent criminal convictions for immigration offences or certain other crimes, such as fraud or money laundering
- Applicants can also not apply if they have had a sponsor licence revoked in the last 12 months.
- Be able to provide company accounts, proof of VAT registration, evidence of trading, proof of UK connections, and proof of industry inspections for any associated companies.
Creating a solid case for why you should be successful can be complex, but not with our team helping you. We ensure that you are eligible and ready to submit your case before any paperwork gets sent across to ensure you are not subject to delays or a failed application. We also provide expert consulting to help you set up your company for professional and compliant trading once your application is approved.
The world of immigration law is constantly changing. With our team, you have access to up-to-date information that ensures you are always caught up.
What Type of Visa Applications Does a Sponsor Licence Allow For?
UK Skilled Worker Visa and Temporary Worker Visas This covers all applicants who have received an official job offer from a UK business that is approved to hire from overseas, which the sponsor licence facilitates.
Without being a licence holder the employee’s visa would not be approved, and the hiring business could stand to face fines or legal action for not following the correct procedures. The UK’s points-based system displays the criteria needed for granted a UK skilled worker visa. These elements ensure that workers are protected and that UK home office processing time is minimised.
This form of visa was previously known as the Tier 2 visa but was replaced in 2020 post the UK leaving the EU.
The works that this visa allows to be hired are listed below:
- Creative Workers
- Scale-up Worker – This is suitable for UK-founded companies who are looking to grow their operations quickly and therefore need many skilled workers to support them.
- Charity Worker (up to one year)
- Religious Worker (up to two years)
- Service Supplier (up to one year)
- Government Authorised Exchange – This includes paid and unpaid work experience of up to one year and research projects, including scientific training for up to two years.
- International Agreement
- Graduate Trainee (Global Business Mobility) – Only approved establishments must conduct this, and proof must be made that the reason for being sponsored by a UK licence holder is to continue working in line with existing studies.
- Secondment Worker
- Seasonal Workers
University Sponsorship If you are planning on offering a university student a place on a course or other form of learning programme, you must also be a sponsor licence holder.
To be eligible for a student visa, the applicants must also meet the following criteria:
- They must have been offered a place on a course that is supported by a government-licensed student sponsor.
- The course must be financially taken care of and not require the student to provide any additional funds in return for studying.
- The student must be able to read, speak, write, and understand English fluently. This is a criterion for getting onto all courses but is included as a requirement as the government wants to know that you are serious about your studies.
Limited Companies - What Documents are Required?
Generally, limited liability companies will need to provide the following documents to ensure a successful application. But bear in mind, documents required can differ for companies with different company structures.
- Business bank statements (12 months)
- Business Lease document
- Business plan
- Previous Company Accounts
- CT600
- CT603
- Employers Liability Insurance
- Hierarchy Chart
