What are the requirements for applying for this these permissions?

Whilst the requirements may seem simple, there are still lots of criteria that you will need to prove that you meet.

One of the main requirements, which is relevant for children born both in and outside of the UK, is that the child must be of good character. This is because, under the British Nationality Act 1981, it is stated only those who are without a criminal record and that have positive references can be accepted for a UK visa. This is only relevant for those aged between 10-18, as anyone younger than this age cannot be judged based on the criteria. For anyone that is over the age of 18, child registration for British Citizenship is not eligible.

If your child was born in the UK, you are eligible to apply for citizenship registration if you meet the below criteria:

  • you got permission to live in the UK permanently after your child was born
  • your child’s father was British or settled in the UK when your child was born
  • you joined the UK armed forces after your child was born
  • your child lived in the UK until they were ten years old (the age at which good character markers become relevant)

Each of these requirements is bound by different visa laws and immigration regulations which are experts in. If your child was born outside of the UK, the process does become slightly more complex. At this time, the requirements for obtaining British citizenship for a child solely depend on the immigration status of their parents. The situations include:

  • If the parent was granted UK citizenship after the child was born. This depends on current immigration status, length of time in the UK, and reasons for the initial visa being granted. 
  • If one of the parents is British. This does mean automatic citizenship will be granted if the parent was legally registered at the time of the birth. 
  • If the child has lived in the UK for over five years. This is legally classed as a settled status for which citizenship can be applied for. 
  • If the child is not eligible for citizenship in any country. Everyone legally is entitled to be a citizen of a country, so if a child is stateless, they will likely be considered for British registration.
