What does this service cover?

If you and your significant other are looking to start a new life in the UK, then you may be eligible for a fiancé visa as part of the government’s family visa scheme. This visa is needed if you plan on living in the UK for more than six months and can either be applied for a new one if you are outside of the UK or intend on extending an existing family visa. 

As of June 2022, more than 303,000 family visas were granted, which correlates to the increase in both work and study visas that have been seen since 2020. Whilst the statistics show a positive story, the reality is that a proportion of UK spouse visas are rejected each year due to inconsistencies in evidence and relationships not meeting the strict criteria for approval.  

What are the requirements for applying for this these permissions?

As with any UK visa application, there are criteria that must be satisfactorily met to stand a chance at receiving an approval. It is not simple as having one approved visa and expecting your family to have the right to reside. They must all meet the requirements needed to function as part of communities and wider society in the eyes of the government.

To criteria that you must meet to obtain a UK spouse or fiancé visa are the following.

Your Partner must be:

  • Based in the UK must be a legal British citizen either through birth or by being awarded British Nationality after a successful application.
  • Be fully settled in the UK meaning they either have indefinite leave to remain, settled status or proof of permanent residence.
  • Be from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status which commence prior to January 1st, 2021.
  • Be aged over the age of eighteen as must the fiancé who is looking to reside in the UK.

Your relationship must meet the below criteria:

  • You must be able to approve that you’ve been living together in a relationship (outside of the UK) or in a relationship for at least two years.
  • You will also need to prove that you are a fiancé, fiancée or proposed civil partner and that you intended on making your legal commitment to each other within the six months of entering the UK.

The fiancé will need to prove that they:

  • Have a good knowledge of English in both written and spoken forms as this needed to successfully immerse oneself into the UK.
  • Can financially support themselves and any further dependants. This can be from a combined financial situation with the partner or via individual means. Either way, financial records will need to be provided.
  • If they have been married or in a civil partnership before, proof must be provided that it has been legally ended.

How can I prove my relationship?

Proving that your relationship is genuine may seem like an unnatural thing to do when you are dealing with the emotional side of wanting to be back together. However, some people have been known to abuse this form of visa in the past, so it is important for the government to understand that any requests are made for legitimate reasons.

You will need to provide documentation from the government, a bank, a landlord, a utility provider, or a medical professional. This needs to prove that you live together and share expenses and have done so for eat least two years. You may also be asked to provide a letter from an official body, such as a doctor or your local council, confirming you have been living together.
